OVERVIEW
Welcome to Shop It.
Shop It is a division and trading name of The Stephens (Pty) Ltd (“Shop It”, “we”, “us” or “our”). We operate this online store and website, including the information, content, features, tools, products and services made available through it (collectively, the “Services”).
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any other policies displayed on our website, govern your use of the Services.
By accessing our website, creating an account or placing an order, you agree to these Terms to the extent permitted by applicable law.
Nothing in these Terms is intended to exclude, restrict or override any rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Protection of Personal Information Act 4 of 2013 (“POPIA”), or other applicable South African legislation.
SECTION 1 – ACCESS AND ACCOUNTS
You may browse our website without creating an account unless a particular feature requires registration.
Where you create an account or provide information when placing an order, you agree to provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account, subject to applicable law.
You must notify us as soon as reasonably possible if you believe your account has been accessed or used without your permission.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
We take reasonable steps to ensure that product descriptions, specifications, images, prices and other information displayed on Shop It are accurate.
Product colours and appearance may vary slightly depending on your device, screen settings, manufacturing variations or other factors.
Product availability may change without notice. We may discontinue products or limit quantities where reasonably necessary.
Nothing in this section limits any rights you may have where goods supplied do not correspond with their description, are defective, unsafe or otherwise fail to meet standards required under applicable South African consumer law.
SECTION 3 – ORDERS
When you submit an order through Shop It, you are requesting to purchase the products contained in your order.
Your order is subject to availability, payment authorisation and acceptance by Shop It.
After receiving your order, we may send you electronic communications confirming receipt and subsequently confirming processing, dispatch or other relevant order information.
We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or product information error, payment cannot be verified, fraud is reasonably suspected, or fulfilment is not reasonably possible.
Where we cancel an order after receiving payment, any amount due to you will be refunded in accordance with applicable law and our policies.
Cancellation and return rights are subject to our Return and Refund Policy and applicable South African law.
SECTION 4 – PRICES AND PAYMENT
Unless otherwise stated, prices displayed on Shop It are shown in South African Rand (ZAR).
Applicable charges, including delivery charges where relevant, will be disclosed during checkout before you complete your purchase.
We may change prices, promotions and discounts from time to time. A price change will not ordinarily affect an order already accepted, except where permitted by applicable law.
We reserve the right to correct genuine pricing, typographical or system errors, subject to applicable consumer law.
You agree to provide accurate and authorised payment information when making a purchase.
Payment processing may be provided by third-party payment service providers. Their terms and privacy practices may also apply when you use their services.
SECTION 5 – SHIPPING AND DELIVERY
Shop It delivers to locations made available during checkout.
Delivery costs and available delivery methods will be displayed during checkout where applicable.
Any delivery timeframe communicated by Shop It is an estimate unless expressly stated otherwise. Circumstances outside our reasonable control may affect delivery times.
We will take reasonable steps to communicate significant delays that become known to us.
Customers are responsible for providing accurate delivery information and for ensuring that someone is reasonably available to receive an order where required.
Our Shipping Policy contains additional information concerning delivery, tracking, failed delivery attempts and related matters.
Nothing in these Terms transfers risk or responsibility to a consumer in a manner inconsistent with applicable South African law.
SECTION 6 – RETURNS, REFUNDS AND DEFECTIVE PRODUCTS
Returns, exchanges and refunds are governed by our Return and Refund Policy and applicable South African consumer law.
Where goods supplied by Shop It are defective, unsafe, unsuitable for their intended purpose or otherwise fail to meet applicable legal standards, customers retain the remedies available to them under the CPA and other applicable legislation.
Nothing in these Terms limits statutory warranties, refund rights or other remedies that cannot lawfully be excluded.
SECTION 7 – INTELLECTUAL PROPERTY
Unless otherwise indicated, the Shop It website, branding, original graphics, written content, design elements and other original materials belonging to us are owned by or licensed to Shop It and/or The Stephens (Pty) Ltd.
Third-party product names, trademarks, logos, images and other intellectual property remain the property of their respective owners.
You may use our website for lawful personal purposes. You may not reproduce, distribute, commercially exploit or falsely represent our proprietary material as your own without appropriate permission.
Nothing in these Terms transfers ownership of intellectual property to you.
SECTION 8 – THIRD-PARTY SERVICES AND TOOLS
Shop It may use or provide access to third-party services, including payment processors, delivery providers, analytics services, applications and other technology providers.
Some third-party services may be governed by separate terms and privacy policies.
To the extent permitted by law, we are not responsible for independent third-party services that are outside our reasonable control. This provision does not limit any responsibility that applicable law places on Shop It.

We do not necessarily control or endorse the content, security, availability or practices of independent third-party websites.

SECTION 10 – RELATIONSHIP WITH SHOPIFY
Shop It’s online store is powered by Shopify, which provides the technology used to operate the online store.
Purchases made through Shop It are transactions between the customer and Shop It / The Stephens (Pty) Ltd, and not a sale by Shopify.
Shopify may process certain information as necessary to provide its platform and related services. Further information regarding the processing of personal information is provided in our Privacy Policy and, where applicable, Shopify’s privacy documentation.
Nothing in this section excludes any rights or remedies that cannot lawfully be excluded.

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, delivery charges or other information.
We may correct errors and update information when reasonably necessary, subject to applicable consumer law.
Where an error affects an order already placed, we will deal with the matter reasonably and in accordance with applicable law.

You may not use Shop It or its Services:
- for unlawful or fraudulent activities;
- to infringe intellectual property or other legal rights;
- to transmit malicious software, viruses or harmful code;

Termination does not affect rights or obligations that arose before termination.

Nothing in these Terms excludes or limits any warranty, guarantee, right or remedy that cannot lawfully be excluded under the CPA or other applicable legislation.
Where permitted by law, information made available through the website for general informational purposes is provided without guarantees beyond those expressly provided by us or required by law.
Any limitation or exclusion contained in these Terms applies only to the extent permitted by applicable South African law.
SECTION 17 – LIMITATION OF LIABILITY
To the extent permitted by applicable law, Shop It and The Stephens (Pty) Ltd will not be liable for indirect, incidental or consequential losses arising from circumstances outside our reasonable control.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms excludes or restricts consumer rights or remedies that cannot lawfully be waived under the CPA or other applicable South African legislation.
SECTION 18 – EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for delays or failures caused by circumstances genuinely outside our reasonable control to the extent permitted by law.
Such circumstances may include severe weather, natural disasters, widespread infrastructure failures, major telecommunications interruptions, industrial action, governmental restrictions or other comparable events.
Where such an event affects an order, we will take reasonable steps to communicate with affected customers and fulfil our obligations in accordance with applicable law.
SECTION 19 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be applied or modified to the extent permitted by law, and the remaining provisions will continue to apply.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
A failure by Shop It to enforce a provision of these Terms does not automatically constitute a waiver of that provision.
These Terms, together with the policies referenced herein, constitute the terms governing your use of Shop It, subject always to rights and obligations imposed by applicable law.
SECTION 21 – ASSIGNMENT
You may not transfer your contractual rights or obligations under these Terms where doing so would materially affect our rights without our consent, except where applicable law provides otherwise.
Shop It or The Stephens (Pty) Ltd may transfer rights or obligations as part of a lawful restructuring, sale, transfer or similar business transaction, subject to applicable law.
SECTION 22 – GOVERNING LAW
These Terms of Service are governed by the laws of the Republic of South Africa.
Nothing in this section prevents a consumer from exercising any right to approach an appropriate regulator, ombud, tribunal or court where such right exists under applicable law.

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable legal requirements.
The current version will be published on our website with an updated effective date where appropriate.
Where applicable law requires specific notice or consent for a change, we will comply with those requirements.
